Terms And Conditions
These Terms and
Conditions are a legally binding agreement between eNetWeb
Media (the Company) and the V3 Script User ('you' the Purchaser).
Purchasing the
Auto Email Response Version 3 Script (the V3 Script) constitutes
acceptance and agreement to these Terms and Conditions in
full.
If purchaser
obtained the V3 script as an upgrade or update of a previous
version these terms and conditions replaces and supercedes
any prior conditions.
The company
provides a 60 day money back guarantee. If during the first
60 days after ordering the Version 3 Script, the purchaser
is unsatisfied with purchase may submit a full refund request
via company
Cancel Request Form.
Any such request must be made before the end of 60 days from
the moment the initial payment was made. Upon receiving a
request for a refund access to the V3 Script download area
will be immediately terminated and the V3 Script License will be
de-activated and will no longer work on purchaser domain. No
refund will be issued to a refund request after the 60 days
of ordering.
The purchase
price does not include installation of V3 Script.
Installation instructions are provided. The company can
provide an installation service for an additional charge.
The V3 Script is
licensed for the exclusive use of the original purchaser on
one domain name per licence. Additional licences can be
purchased for additional domains, one domain per each
licence purchase.
If a purchaser
attempts to re-install the V3 Script on a second different
domain on the same licence, the script will automatically be
de-activated and will not work on both domains without
refund of any fees paid. Should the purchaser wish to have
the V3 Script re-activated and working again on the original
domain, the purchaser would have to re-order and pay again
for the V3 Script and to request a new license.
The purchaser is
licensed to use the V3 Script for their own personal use.
The purchaser does not have any rights to resell or
distribute the V3 Script in any way, nor change the
copyright information or company information, graphics,
banners or script code in any way whatsoever.
The Company
retain all copyright ownership of V3 Script, including
templates, designs, text, graphics and source code and will take
full legal action against any person that violates company
copyright.
The purchaser
agrees not to copy, modify, adapt the V3 script or merge it
into another program.
The Company
provides the V3 Script 'as is' without warranty of any kind
either express or implied, including but not limited to the
implied warranties conditions of merchantability or fitness
for a particular purpose. In no event shall the company be
liable for any loss of profits, loss of business, loss of
data, unsecured transactions, interruption of business, or
for indirect special, incidental, or consequential damages
of any kind, even if the company has been advised of the
possibility of such damages arising from any defect or error
in the documentation or script.
The purchaser
agree to indemnify and hold the company and its employees
and agents harmless from and against all liabilities, legal
fees, damages, losses, costs and other expenses in relation
to any claims or actions brought against the company arising
out of any breach by purchaser of these terms and conditions
or other liabilities arising out of the purchaser use of the
V3 Script.
If any of these
terms and conditions should be determined to be invalid,
illegal or unenforceable for any reason by any court of
competent jurisdiction then such term or condition shall be
severed and the remaining terms and conditions shall survive
and remain in full force and effect and continue to be
binding and enforceable.
The company
reserves the right to change these terms and conditions at
any time, and the purchaser continued use of the V3 Script
following any changes shall be deemed to be the purchaser
acceptance of such change.
